I. Generalities When should we start ?

Right NOW!
Even though actual applications cannot be submitted to .ASIA Organization, the dotAsia Registry, until October 9th (See .ASIA Organization’s site for complementary information: http://Registry.Asia) for the so-called “Sunrise” Period reserved for holders of Prior Rights – or before February 2008 for applications opened to everyone else, it is crucial that you submit your applications now! The date of your request alongside the related payment will determine the order in which EuroDNS will submit your application to .ASIA Organization for handling, potential Auction, and validation.

General conditions to get ‘.Asia’ Domain names

  • To obtain a ‘.Asia’ Domain name from .ASIA Organization the applicant (you!) must meet the criteria set-out by the Registry. This apply both for the Sunrise periods or after the start of the General Registration process (on February 2008).
  • .Asia is open to any company or individual with a contact in the Asia Pacific Region that can establish a “Charter Eligibility Declaration” (CED for short, see below). The CED can be the Administrative Contact or the Billing Contact (the Technical Contact has to remain EuroDNS for technical reasons).
  • However, the future holder of the .Asia Domain Name must expressly commit to specific Terms of use of the service, which form a full part of EuroDNS’ Terms & Conditions (http://www.eurodns.com/documents/terms-and-conditions)

What is the annual cost for a ‘.Asia’ Domain name?

EuroDNS will charge its customers € 18 for each ‘.Asia’ domain name registered on their behalf through .ASIA Organization for one year (minimum registration period offered by the Registry outside of Sunrise Period). II Specific Situations - “Sunrise” period for Trademark holders EuroDNS is one of the first Registrars officially accredited by EuroDNS is one of the first Registrars officially accredited by

Please Note: For the avoidance of doubt as well as for any aspect the Sunrise process not covered in this document, the Registrant or Holder agrees that he/she has read and understood the official Sunrise Policy Document provided by the DotAsia Organization at http://www.registry.asia/policies/DotAsia-Sunrise-Policies--COMPLETE-2007-08-10.pdf

1/ What is the Sunrise Period

In order to protect companies and private individuals from abusive registration of ‘.Asia’. Domain names which would infringe their Trademarks, .ASIA Organization created a period defined as "Sunrise" to enable holders of such rights to register the corresponding ‘.Asia’ domain names on a priority basis. The “Sunrise” period is subject to a specific procedure and time restrictions, which will no longer apply for open registrations when the “Sunrise” period is over.

2/ How to benefit from the Sunrise Period

a) Principle The Trademark Sunrise Period will last from October 9th 2007 to January 31th 2008. In order to be protected under Sunrise, the Trademark must be registered in a trademark office/registry present in countries or states from the WIPO ST3 List (See http://www.wipo.int/scit/en/standards/pdf/03-03-01.pdf) Trademark holders will have to provide:

  • Their specific trademark at least three characters long, in unaccented ASCII characters.
  • The Trademark or serial number from the Trademark Registry
  • The Trademark application date (when the TM has been submitted for Registration) as recorded by the Trademark Registry.
  • The Trademark registration date (when the TM has come into full force and effect) as recorded by the Trademark Registry.
  • The Class in which the Trademark has been Registered, from the Nice Classification (see http://www.wipo.int/classifications/nivilo/nice/)
  • The Country or Locality in which the Trademark has been Registered.

b) Points to note

  • In order to be valid under the Sunrise, the Trademark cannot be shorter than three characters. In addition, only selected characters are available for the trademark: letters, numbers, spaces, punctuations and special characters (which must be omitted or replaced by hyphen). Accented and combined characters must be replaced by their equivalent base character.
  • The country in which the Trademark has been registered must be entered using the relevant ISO Code (see http://www.iso.ch/iso/en/prods-services/iso3166ma/02iso-3166-code-lists/list-en1.html).
  • When asked to specify a date for the Trademark, use the following format: YYYY-MM-DD (i.e.: October 9th 2007 gives « 2007-10-09 »)
  • In order to be protected under the Early Bird Sunrise, Trademarks must have been filled before March 16th 2004. For General Sunrise and Entity Sunrise, Trademarks must have been filled before December 6th 2006.
  • No documentary evidence will be asked of the Customer to support the Sunrise request, the accuracy of the data will be enough by itself in most cases. However, .ASIA Organization may have to make a posteriori checks. In that case, you will have to forward the documentary evidence to EuroDNS which will then send it to .ASIA Organization.

EuroDNS is one of the first Registrars officially accredited by

c) Early Bird and General Sunrise (S2a and S2b)

  • S2a and S2b are devised to allow TM holders to register domain names based solely on their trademarks as they are registered in the relevant TM Registry. The TM itself (and it alone) can be registered as a .ASIA Domain Name.
  • In order to be eligible for protection under S2a, the Trademark must have been applied for on or before March 16, 2004.
  • In order to be eligible for protection under S2b, the Trademark must have been applied for on or before December 6, 2006.

EuroDNS is one of the first Registrars officially accredited by

d) Extended Sunrise (S2c)

  • Sunrise 2c is devised to allow TM holders that would qualify for S2a and S2b to register domain names that are more descriptive of the activity attached to the Trademark, using the Nice Classification Class (see http://www.wipo.int/classifications/nivilo/nice/index.htm).
  • The .ASIA Domain Name registered under S2c would be the TM itself and any additional significant word or phrases that appear in the title, subtitle or description of the Class.
  • As stated by the Registry: “To be an Acceptable Extension to the Domain Name Applied For, the word(s) taken from the class title, subtitle or description to be appended to the Registered Mark must be a significant enough word to identify the class the mark is associated with”.
  • During the Domain Name Registration process with EuroDNS you will be prompted to select the relevant Class for which you seek additional protection. The Validation Agent for dotAsia Organization will then check if the word attached to the Trademark is a part of this class significant enough to create a Domain Name with this combination.
o For example, “Class 1” based on the 9th edition of the NICE Classification by the World Intellectual Property Organization (WIPO) has the following description: “Chemicals used in industry, science and photography, as well as in agriculture, horticulture and forestry; unprocessed artificial resins, unprocessed plastics; manures; fire extinguishing compositions; tempering and soldering preparations; chemical substances for preserving foodstuffs; tanning substances; adhesives used in industry.” A Registered Mark for “ABCD” under this class may therefore apply for “ABCDChemicals.asia”, “ChemicalsABCD.asia”, “ABCD-Tanning-Substances.asia” or “ABCDFireExtingusihingCompositions.asia” etc., but not “ABCD-in-industry.asia” or “ABCDunprocessed.asia”.

EuroDNS is one of the first Registrars officially accredited by

e) Entity Sunrise (S3)

  • Sunrise 3 is devised to allow preliminary registration for companies, organisations, societies, partnerships… That are not eligible as a Trademark (if a Registration is awarded for the same string under a Trademark Sunrise, the application for S3 will be automatically cancelled).
  • As stated by the Registry: For those entities whose names are themselves registered trademarks (or for SR3), entity type identifiers such as “Ltd.”, “Co. Ltd.”, “Inc.” may be omitted to form the Domain Name Applied For. For example, “ABCD Ltd.”, “Ltd.” may be omitted from the Domain Name Applied For, and “ABCD.asia” shall be considered acceptable.
  • To benefit from Sunrise 3, the Company must be in good standing and provide documentary evidence to the name such as, but not limited to, a receipt from the Registry of commerce. Such document must be provided to the Registry either as a PDF or a link to a relevant web page.

3/ Auction Process

While the First Come First served principle will apply after Sunrise, the dotAsia Organization elected to allow for holders of similar trademarks to compete without being tied to mere timing. Using the “open auction” process, a Registrant whose information has been successfully pre-approved can bid for a particular trademark for which it holds the relevant documentation. If the bid is successful, the Registrant will then be awarded the .asia Domain Name. As stated by the Registry: “Auctions will be held exclusively amongst eligible bidders. As such, this is described as a “closed auction” as opposed to an “open auction” where additional bidders (i.e. other domain name applicants) may join in at anytime during the auction period. A conventional “English-style” auction format where eligible bidders will bid against one another, with each bid being higher than the previous bid will be used. Each Applicant (i.e. bidder) will be able to observe the price of each bid placed by itself or its competitors. That is, the current bid price and whether or not the Applicant is the leading bidder. The auction ends when no participant is willing to bid further within a reasonable period of time as determined by the Registry or its auction agent, and the winner being the highest bidder.” You can withdraw from an auction provided that the Registry is notified in good time and in any event prior to the commencement of the auction. If there is only one bidder remaining after such a withdrawal, the auction will be cancelled and the domain allocated to the remaining bidder. Because EuroDNS is an accredited Auction provider for .Asia Sunrise, you can bid directly from this site… The .ASIA domain name of your choice may be one click away!

4/ Costs Due to its specific level of protection,

Sunrise Registration is subject to an increased price, directly determined by .ASIA Organization. This is why a minimum of two years registration is mandatory and a non refundable € 90 premium will be charged.

5/ Disputes on a Sunrise Registration

Should you believe a Sunrise Registration is infringing on your legitimate rights, or that a .ASIA was wrongly awarded, you can initiate a Reconsideration process.

6/ Landrush and Auction Before the General Opening,

dotAsia Organization creates a specific period where anybody can submit a request on a first come first served basis without any particular link to a trademark or verification. However, if two or more requests for the same string of characters are submitted, the winning registration will be determined by an Auction, under an identical process to the Sunrise’s.

III. Registering a .Asia Domain Name

1/ General Principle

Go and browse the new version of our EuroDNS site – http://www.eurodns.com – and select “.Asia Domain Name”. Input the domain name you wish to Register and the Period for which you wish to get it: Early Bird or Regular Sunrise, Landrush or General Registration. The costs for the Registration will be displayed in your cart, including the Sunrise Premium of € 90 and the two-years minimum for this period. You can modify your request or go directly to payment of the complete sum displayed on the page. Once the payment has been processed, your request will be dated and recorded in our system and in your EuroDNS Customer account area. It will then be transmitted to .ASIA Organization, once the Registry opens for the submission of registrations. Before the opening of October 9th, you can go back to your order to specify or modify contact information including your local contact meeting the Charter Eligibility Declaration document. This submission will be made as quickly as possible reflecting the access limitations applied by .ASIA Organization, and the sequence in which your paid application was accepted on our Website. The Auction process should then starts during the two-weeks period. You will then be informed of the outcome of the Auction.

2/ Charter Eligibility Declaration or CED

Due to the specific nature of the TLD, DotAsia Organization wishes a tangible link between the .ASIA Domain Name and the Asia Region. To that end, you need to specify at least one of your contacts as the CED meeting the Registry’s requirement (see http://www.dotasia.org/policies/DotAsia-Charter-Eligibility--COMPLETE-2007-08-15.pdf for official details). a) Information The CED can be a company or an individual but must submit the following information:

1. Locality of establishment of the Entity

See http://www.iso.ch/iso/en/prods-services/iso3166ma/02iso-3166-code-lists/list-en1.html

2. Type of Entity

  • a. Corporations or Companies
  • b. Cooperatives
  • c. Partnerships or Collectives
  • d. Government Bodies, States, Sovereigns or Municipalities
  • e. Political parties or Trade Unions f. Trusts, Estates, Associations or Societies
  • g. Institutions h. Natural Persons i. Other

3. Form of Identification

  • a. Certificate of Incorporation or equivalent business registration certificate issued by the relevant government registry as confirmation of the due incorporation and valid existence of the company
  • b. Act, decree or legislation chartering the formation of an entity
  • c. Societies Registry or equivalent registry for non-corporate entities
  • d. Political Parties Registry
  • e. Passport or Citizenship ID
  • f. Other

4. Identification Number / Code of Reference
(e.g. Passport number, Business Certificate number, Act or Legislation number/code, etc.)

a) If 2(i) and/or 3(f) ("other") is declared, the appropriate information for the Type of Legal Entity and Form of Identification to support the claim must be provided.

b) Disputes and Consequences As stated by the Registry: the CED Contact is responsible only for acknowledging the dispute proceedings and to refer the case to the Registrant Contact. The Registrant Contact shall remain solely regarded as the Registered Domain Holder for all general purposes including all operations and liabilities regarding the use of the domain. […]The CED Contact is expected to respond and acknowledge dispute proceedings and to refer the case to the Registrant Contact. The CED Contact further agrees that the Registrant Contact shall nevertheless remain the operating contact for all operations and liabilities regarding the use of the domain, including but not limited to domain transfer and updates, or in other words be solely regarded as the Registered Domain Holder for all general purposes. EuroDNS is one of the first Registrars officially accredited by

c) EuroDNS can be your CED! In order to facilitate .ASIA Registration for its loyal customers, EuroDNS will allow its Korean subsidiary to be used as the Charter Elegibility Declaration contact. If you do not have an Asian CED to provide at the time of Registration, just choose EuroDNS Korea in the relevant pop-up menu. As an introductory offer and to allow you to make the most of the Sunrise Period, the EuroDNS CED Service is provided Free of Charge, at no extra cost to your Sunrise registration for the first year. Later on, we will communicate to you the relevant pricing, which you must agree to pay should you wish to continue the Service. Please note however that the Introductory offer does NOT cover costs legal, administrative or otherwise, that EuroDNS may have to incur through your use of the CED Service and that will remain at your charge at all time and be invoiced to you at EuroDNS’ sole discretion. We at EuroDNS are happy to support you throughout this important process, bringing you the highest quality of service. Be sure we will help you to make the most of your .ASIA identity on the Internet. Yours sincerely, The EuroDNS Management Team

.ASIA auctions

1. Why an Auction?
Because many .Asia domain names will be highly sought after, the .Asia Registry has partnered with Pool.com to create an auction process. Under this scheme, several applicants for the same domain name (whether in Sunrise or in Landrush phases) can each bid for the chance to become the exclusive registrant of the name.
Since EuroDNS has been accredited as an “Auction Provider”, this website (
www.EuroDNS.com) can serve as an interface for the Pool.com service for .Asia domain names. Kindly note that while the EuroDNS Interface is a convenient way to follow and participate in an auction on a domain name for which you submitted a registration request, EuroDNS has no control over the Pool.com auction system.
This documents outlines certain rules that you agree to follow by entering a .Asia auction using the EuroDNS platform.

2. The Auction Process
a) The DotAsia auction model follows the standard “English auction” model: participants bid against one another, with each bid being higher than the previous bid. The auction ends when no participant is willing to bid further.
b) If Registrant1 submitted a domain application for Toto.asia through its Registrar (i.e. EuroDNS) and Registrant2 submitted another domain application for Toto.asia through its own Registrar (i.e. Registrar X), and that both applications were approved by the .Asia Registry, Registrant1 and Registrant2 will both be able to participate in an auction for Toto.asia. The highest bidder at the end of the auction will be the only Registrant of Toto.asia.
c) Please note that auctions for the .Asia Domain Names can only be made by the “OPN” contact. As defined by the .Asia Registry, the “Operations and Notifications Contact” is the contact to whom documentary evidence requests, auction invitations, and reminders are to be sent and which you specificied to EuroDNS when you submitted your .Asia Registration(s).
d) Remember that only domain applications that have been approved - and if applicable validated - by the Registry may be eligible to the auction process. For example, in the case of a Sunrise application, the auction is only open to holders of the relevant Trademark. Asia auctions are “closed” because only valid applicants in the same category (Sunrise or Landrush) can bid against each other.

3. The EuroDNS Auction Interface
EuroDNS is one of the few .Asia Registrars to be an accredited auction provider and has done so to provide a consistent experience across the board to its customers. While the system remains operated by Pool.com, as a customer of EuroDNS you do not need to leave the site to perform your bidding operations and stay informed of the evolution of the bidding.
a) Open Auctions
If one of the .Asia Domain names you applied for is now part of an Auction, it will show up on this page. Clicking on the name, you can specify your maximum bidding amount or increase your bid depending on what your competitors are doing.
b) Upcoming Auctions
Not all auctions start at the same date depending on the application period. Come check this page often to avoid missing a potential auction. Remember, all times are specified in Universal Time (GMT).
c) Auctions history
Use this page to find where a specific bid stand, if a domain was awarded to somebody or if you won an auction.

4. Understanding the Auction Steps
a) Get ready
Once an auction is scheduled for competing Domain Name applications, .Asia Registry and/or Pool.com shall notify each OPN contact that the process will start soon. The warning will usually be sent ten (10) days in advance, execept for unforseen delay. As soon as the Registry and/or Pool.com has sent such a warning, EuroDNS will post a notice in the OPN's customer account. Kindly note that while it will make its best efforts to warn its customers soon enough, EuroDNS has no control over the warning process used by the Registry or potential delays.
b) Start
Auctions are scheduled to start on business days (Monday through Friday Canadian) and will have an initial close date seven (7) days later.
c) Bid!
Bids will be processed according to the “English auction” model. A bid will be considered the "maximum" that a bidder is willing to bid to but not necessarily what will be bid at this time.
Using the .Asia system, Bidders can set a maximum bid limit for a domain name, i.e, the maximum amount they are willing to pay for the domain during the auction. Within such limit, the bidding can therefore be “automatic” because the system will continue bidding for you until the bidder's maximum is reached (the system is called “proxy bidding” and is usually used by online auction companies).
Essentially, any new bid must be at least one increment higher than the previous bid in order to establish a new leader. Bids below the current auction price will have no effect on the auction. The auction system will automatically apply bids up to the customer's proxy bid provided each time it is at least one increment higher than the current bidder.
d) Outbid ?
Whenever an auction leader changes, notifications will be sent to the previous leader that they have been outbid. Previous "leaders" will have already received an outbid notification when their bid was first surpassed. The EuroDNS interface will display the applicable information on the www.eurodns.com/asiaAuctions/ page.
e) Closing of the Auction
An auction can only close when there has not been a change in leader for 24 hours. This ensures that bidders from all time zones around the world have the opportunity to respond to an OUTBID message before the auction closes. The only circumstance where there may not be an auction winner would be if no bids were placed at all.
The winning bidder and all losing bidders will receive appropriate notification from Pool.com and/or the .Asia Registry. Information shall also be posted on the www.eurodns.com/asiaAuctions/ page.
