Specific Terms: Defensive Registration Service for .RU, .РФ and .SU

Specific Terms and Conditions applicable to the Defensive Registration Service provided by EuroDNS S.A. in respect of Domain Names registered under the .RU, .РФ and .SU Extensions.
These Specific Terms and Conditions, the Specific Terms and Conditions: Domain Name Service and the General Terms and Conditions shall be interpreted and applied together as a single instrument (the "Agreement"). To the extent there is a direct conflict between these terms and either of those texts, these terms shall prevail.
These terms apply to the exclusion of the Specific Terms and Conditions: Local Presence Service in respect of the .RU, .РФ and .SU Extensions.
Capitalised terms defined in the General Terms and Conditions and in the Specific Terms and Conditions: Domain Name Service shall have the same meaning herein.
1. Definitions
Defensive Registration: a Domain Name maintained principally for the protection of the Customer's trade marks, corporate name or other distinctive signs, which is not intended for and is not put to active commercial or operational use.
Identification Requirement: the requirement, under the law of the Russian Federation and the applicable Registry Policy, that the person recorded as the administrator of a Domain Name registered under the .RU, .РФ or .SU Extension be identified by means of the national identification system of the Russian Federation.
Local Representative: the Provider appointed by EuroDNS, from time to time and at its sole discretion, to be recorded as the administrator of the Domain Name for the purposes of the Identification Requirement.
2. The Service
2.1. The Customer to whom the national identification system of the Russian Federation is not accessible cannot satisfy the Identification Requirement by its own means. Where the Customer subscribes to the Defensive Registration Service, EuroDNS shall procure that the Local Representative is recorded as the administrator of the Domain Name, for the sole purpose of satisfying that requirement.
2.2. The Defensive Registration Service is chargeable, per Domain Name, and is subscribed to and renewed together with the Domain Name.
2.3. The Customer remains free to satisfy the Identification Requirement by any other means of its choice, including by appointing its own local representative or by contracting directly with a Registrar accredited in the Russian Federation.
3. Eligibility and permitted use
3.1. The Service is available only for Domain Names which qualify as Defensive Registrations and which remain inactive throughout the period during which they benefit from the Service.
3.2. For so long as a Domain Name benefits from the Defensive Registration Service, the Customer shall not use it, and shall not allow it to be used, for the operation of a website or of any other publicly accessible Content, for the sending or receipt of electronic mail, for the operation of any application, service, redirection or interface, or for any other active commercial or operational purpose.
3.3. By derogation from article 1.4 of the Specific Terms and Conditions: Domain Name Service, the Domain Name shall be delegated exclusively to the DNS servers designated by EuroDNS and the Customer shall not be entitled to modify that delegation.
3.4. By derogation from article 1.7 of the Specific Terms and Conditions: Domain Name Service, the Customer may not deny EuroDNS the right to point the Domain Name to a Parking Page. The Customer acknowledges that the Domain Name will not resolve, or will resolve only to a page indicating that it is registered.
3.5. The Customer shall inform EuroDNS without delay if it intends to put a Domain Name to any use falling outside article 3.1. The Domain Name shall in that case be withdrawn from the Defensive Registration Service before such use begins, and the Customer shall satisfy the Identification Requirement by its own means. Neither EuroDNS nor the Local Representative is under any obligation to continue to act in respect of a Domain Name which has ceased to qualify as a Defensive Registration.
3.6. Any breach of this article constitutes a breach of article 10 of the General Terms and Conditions and entitles EuroDNS to withdraw the Defensive Registration Service and to suspend or delete the Domain Name with immediate effect and without prior notice.
4. Status of the Domain Name
4.1. The Customer acknowledges that the Local Representative will appear in the Registry and Registrar records as the administrator of the Domain Name.
4.2. As between the Customer, EuroDNS and the Local Representative, the Customer remains the beneficial owner of the Domain Name. Neither EuroDNS nor the Local Representative acquires any ownership, intellectual property right, goodwill or economic interest in the Domain Name by reason of the Defensive Registration Service.
4.3. The Customer nevertheless acknowledges that the position of administrator carries rights and obligations under the law of the Russian Federation, that the recognition and enforcement of the Customer's beneficial ownership before the Registry, the Registrar, the courts and the authorities of the Russian Federation cannot be guaranteed, and that this constitutes an inherent risk of the Defensive Registration Service which the Customer accepts.
4.4. No contractual relationship is created between the Customer and the Local Representative. The Customer shall not contact the Local Representative directly and shall address all requests relating to the Domain Name to EuroDNS via the Customer Account.
4.5. EuroDNS is not required to disclose the identity of the Local Representative beyond the details registered in the whois database.
4.6. The Customer acknowledges that the Local Representative may be required by the law of the Russian Federation, or by a competent authority, Registry or Registrar, to act in respect of the Domain Name without, or contrary to, the instructions of EuroDNS or of the Customer, including by suspending, blocking, transferring, modifying or deleting it, or by disclosing information relating to it. EuroDNS is under no obligation to challenge any such measure.
5. Personal data
5.1. In addition to the authorisation given under article 9 of the Specific Terms and Conditions: Domain Name Service, the Customer expressly authorises EuroDNS to disclose the data referred to in that article to the Local Representative.
5.2. The Customer acknowledges that the Local Representative, the Provider and the Registry are established in the Russian Federation, that the Russian Federation is not the subject of an adequacy decision of the European Commission, that the disclosure is necessary for the performance of the Agreement and for the compliance of the Domain Name with the Identification Requirement, and that neither the level of protection afforded to the data after disclosure nor the ability of data subjects to exercise their rights in the Russian Federation can be guaranteed by EuroDNS.
6. Fees and absence of refund
6.1. By derogation from articles 7.2, 9.6 and 14.4 of the General Terms and Conditions, and in accordance with article 4 of the Specific Terms and Conditions: Domain Name Service, the fees paid for the Defensive Registration Service are non-refundable. No refund and no pro rata credit shall be due where the Domain Name is withdrawn from the Defensive Registration Service, transferred, suspended or deleted, or where the Defensive Registration Service is suspended, discontinued or terminated, before the end of the period paid for, whatever the cause and whichever party is at the origin of it.
6.2. The Customer acknowledges that a Domain Name under the .RU, .РФ or .SU Extension cannot be registered or renewed unless it satisfies the Identification Requirement by its own means or the Defensive Registration Service is subscribed to and paid for in respect of the corresponding period. And, further, that the non-payment of the fees for the Defensive Registration Service will result in the Domain Name not being renewed and, ultimately, in its deletion.
7. Change of Local Representative
7.1. EuroDNS may replace the Local Representative at any time, at its sole discretion and without prior notice.
7.2. The Customer authorises EuroDNS to take, and to instruct the Local Representative and the Registrar to take, all steps required to give effect to such replacement, including the transfer of the Domain Name between Registrar accounts and the modification of the registration data.
8. Suspension and termination
8.1. Without prejudice to articles 7.2, 14.4 and 15 of the General Terms and Conditions and to article 5 of the Specific Terms and Conditions: Domain Name Service, EuroDNS may suspend or terminate the Defensive Registration Service, in whole or in respect of any Domain Name, with immediate effect and without prior notice, where:
a) the arrangement between EuroDNS and the Local Representative terminates or is suspended, for whatever reason, or the Local Representative ceases or refuses to act in respect of the Domain Name;
b) a change in the law of the Russian Federation, in the Registry Policy or in the practice of the competent authorities, the Registry or the Registrar prevents or materially impedes the provision of the Defensive Registration Service, or renders it unlawful or, in the reasonable opinion of EuroDNS, unduly risky; or
c) the continued provision of the Defensive Registration Service would or might cause EuroDNS or any company of the Namespace group to act in breach of any restrictive measure referred to in article 5.
8.2. Upon suspension or termination of the Defensive Registration Service, it is the sole responsibility of the Customer to satisfy the Identification Requirement by its own means, within the period notified by EuroDNS. The Customer acknowledges and accepts that failure to do so will result in the Domain Name ceasing to comply with the Identification Requirement and, consequently, in its suspension or deletion.
8.3. EuroDNS shall, to the extent lawfully and technically possible, use its best efforts to procure the transfer of the administration of the Domain Name to the Customer or to a person designated by it. EuroDNS gives no undertaking that such transfer can be completed.
9. Transfer to another Registrar
9.1. In addition to the conditions set out in article 1.6 of the Specific Terms and Conditions: Domain Name Service, the Domain Name may not be transferred to another Registrar for so long as it benefits from the Defensive Registration Service. The Customer must first satisfy the Identification Requirement by its own means and inform EuroDNS accordingly.
9.2. The Customer acknowledges that such a transfer requires the intervention of the Local Representative and of the Registrar, that it may be subject to conditions and delays imposed by the law of the Russian Federation and by the Registry Policy, and that it may prove impossible to complete.
10. Additional limitations of liability
In addition to the limitations set out in article 11 of the General Terms and Conditions, EuroDNS shall not be held liable for any loss or damage arising out of or in connection with:
a) any decision, injunction, requirement or measure of any authority, court, Registry or Registrar of the Russian Federation affecting the Domain Name, including its suspension, blocking, seizure, transfer or deletion and any disclosure of information relating to it, and the absence of any challenge to such a measure;
b) the absence of resolution of the Domain Name and the absence of any active use of it, which are inherent characteristics of the Defensive Registration Service;
c) the replacement of the Local Representative pursuant to article 7, including any period during which the Domain Name is suspended, does not resolve or is unavailable for management;
d) the impossibility of transferring the Domain Name, or of establishing or enforcing the Customer's beneficial ownership of it, in the Russian Federation; or
e) the adoption of any restrictive measure affecting the Customer, the Local Representative, the Registry, the Registrar or any bank or payment intermediary.
11. Guarantee
11.1. The guarantee given by the Customer under article 12 of the General Terms and Conditions and article 8 of the Specific Terms and Conditions: Domain Name Service extends to the Local Representative, its employees, directors, officers, representatives, agents and affiliates.
11.2. The Customer shall further indemnify EuroDNS against any sum which EuroDNS is required to pay to the Local Representative as a result of the Customer's breach of these Specific Terms and Conditions.
12. Local Representative terms
Additional terms of use of the Local Representative may apply. EuroDNS shall publish the current version of those terms or, failing that, a hyperlink to the website on which they are available.
