Specific Terms: SSL Certificates Service

Specific Terms and Conditions applicable to the SSL Certificates Service provided by EuroDNS S.A.

Please note: This English version is only for informational purposes. The French version is the only binding version between EuroDNS and the Customer.

These Specific Terms and Conditions and the General Terms and Conditions shall be interpreted and applied together as a single instrument (the "Agreement"). To the extent there is a direct conflict between these terms and the General Terms and Conditions, these terms shall prevail. Capitalised terms defined in the General Terms and Conditions shall have the same meaning in the Specific Terms Conditions.

In its capacity as an authorised reseller, EuroDNS provides the Customer with a range of services for the issuance and management of digital certificates based on the Secure Sockets Layer protocol (the "SSL Certificate Service") as defined hereafter and for which the Customer has submitted an Order Form pursuant to the General Terms and Conditions.

Pursuant to these Specific Terms and Conditions, EuroDNS allows the Customer to obtain SSL digital certificates (the "Certificate") from the following certification authorities (the "Authority" or the "Authorities"):

In order to facilitate the procedure for obtaining the Certificate, EuroDNS allows the Customer to initiate it during a period of three (3) months following the date on which EuroDNS accepted the order.

The Customer is expressly informed that if they fail to initiate the Certificate issuance procedure within this period, they will lose all right to obtain the Certificate and will not be entitled to any refund.

The Customer is further informed that the issuance procedure may only be carried out from the Customer Account via which the Customer placed their order for the Certificate.

Upon receipt of the payment for the Order Form, EuroDNS makes available to the Customer, in their Customer Account, a token allowing them to initiate this procedure (the "SSL Voucher").

The issuance of the Certificate will be subject to a mandatory validation procedure. This procedure, detailed on the EuroDNS Site, will depend on the type of Certificate chosen by the Customer. It is for the Customer to follow the applicable procedure in order to obtain the Certificate from the Authority they have chosen.

In order to avoid an unwanted expiration of the Certificate, EuroDNS enables the Customer to activate an automated renewal option in the Customer Account.

If this option is activated, EuroDNS will attempt to renew the Certificate prior to its expiration date and for the term selected by the Customer. This automated renewal shall be operated in accordance with the terms of article 6 of the General Terms and Conditions.

If the automated renewal option is deactivated, the Customer will need to renew their Certificate manually, via the Customer Account, before its expiration date. EuroDNS will notify the Customer several times of the expiry of its validity and of the renewal procedures, by sending emails using the Customer Details. EuroDNS cannot be held liable if the Customer fails to take the necessary action to renew their Certificate or in the case of the Customer Details being inaccurate or obsolete and, more generally, in case of the Customer failing to receive the email in question. The Customer remains solely responsible for the renewal of their Certificate.

If the Customer fails to renew their Certificate before its expiration date, the Certificate will lapse pursuant to the Authority's terms of use.

In order to redeem the SSL Voucher and obtain the Certificate the Customer must agree to the terms and conditions applicable to the services provided by the Authorities; the current version are available at:

The Customer expressly understands and accepts that EuroDNS has no control whatsoever over the services provided by the Authorities nor the terms and conditions applicable to such services.

EuroDNS makes no warranty of any kind, expressed or implied, as to the SSL Certificate Service's merchandisableness or fit for a particular purpose. Any warranty given by the Authorities falls under the sole responsibility of the latters.

The Customer is expressly informed that the resale of SSL Vouchers is strictly forbidden. Any breach of this prohibition will automatically lead to the immediate cancellation without any refund of all applicable Certificates.

As part of the Domain Name Service, EuroDNS may, at its sole discretion, elect to offer a Certificate to the Customer for each domain name they register with EuroDNS.

The Customer understands and accepts that the free Certificate offered by EuroDNS may only be redeemed for domain names registered with EuroDNS. Thus, the Customer accepts that any registrar transfer of a Domain Name benefitting from this special offer will automatically trigger the revocation of the applicable Certificate.

The Customer understands and accepts that EuroDNS makes no warranty as to the duration of this special offer.

When providing the SSL Certificate Service, EuroDNS acts as a mere intermediary of the Authorities. EuroDNS therefore provides this Service without any warranty other than that the Customer's order will be transmitted to the relevant Authority.

Upon receipt of the payment for the Order Form for a Certificate, EuroDNS will make the corresponding SSL Voucher available to the Customer in the Customer Account, allowing them to initiate the procedure for obtaining the Certificate they ordered.

The Customer commits not to use the SSL Certificates Service for any illicit or fraudulent purposes and more generally, in any way breach the principles set forth by article 10 of the General Terms and Conditions.

The Customer understands that any improper use of the SSL Certificates Service may result in the immediate, and without prior notice, suspension of the Certificate by EuroDNS and/or the Authority, as well as the complete suspension of the Customer Account if EuroDNS deems it necessary.

The Customer accepts that neither EuroDNS nor the Authorities can be held liable for the use of the Service made by the Customer.

The Customer commits to hold harmless EuroDNS and the Authorities against any claim and/or suit from any third party based on or arising from the Customer's use of the Service. This guarantee includes among others that the Customer will fully indemnify EuroDNS and/or the Authorities for any direct or indirect damages such as but not limited to, all administrative, judiciary or extra judiciary costs incurred for EuroDNS and/or the Provider by the Customer's use of the Service.

EuroDNS' support for the SSL Certificates Service will be exclusively limited to the basic setup of the Certificate.

The validation procedure and more generally, technical support for the Certificate will be provided directly by the Authorities.

The Customer understands and agrees that unless otherwise provided all fees applicable to the SSL Certificates Service are non-refundable.

The Customer having the legal status of consumer pursuant to the Luxembourgish consumer code are expressly informed that the SSL Certificate being considered a customised good, pursuant to article L.222-5 of this code, the SSL Certificates Service is not subject to the statutory right of withdrawal.

The Customer further acknowledges that the early termination of the SSL Certificates Service does not entail the refunding of any monies paid to EuroDNS nor does it release the Customer from their obligation to pay all fees applicable to the Service they have ordered.

In accordance with article 7.2 of the General Terms and Conditions, EuroDNS retains the right to discontinue or suspend at any time, temporarily or permanently any part or the entirety of the SSL Certificates Service.

The Customer understands and accepts that EuroDNS cannot be held liable by the Customer or any third party for any consequences resulting from such modification, suspension or discontinuance of the SSL Certificates Service.

10.1. The Customer may request the termination of the SSL Certificates Service at any time. Such termination will be operated after a period of one (1) month following the receipt by EuroDNS of a written request sent by registered mail to the address specified in article 1 of the General Terms and Conditions.

10.2. The Customer accepts that in certain circumstances, EuroDNS will be entitled to terminate provision of the SSL Certificates Service without prior notice. Circumstances where such termination may happen, without it being deemed a default of EuroDNS towards its contractual or legal obligations, include but are not limited to:

• use of the SSL Certificates Service by the Customer for illicit purposes; and/or
• failure by the Customer to pay to EuroDNS any fee due for the SSL Certificates Service provision.

10.3. The Customer expressly agrees that no refund shall be granted in the case of termination of the SSL Certificates Service and/or the whole Agreement.
